Germany Considers Letting Developers Return Awarded Offshore Wind Areas
29 October 2026
Katherina Reiche, Germany's federal minister for Economic Affairs and Energy, has expressed an intention to let developers return offshore wind areas that have already been awarded. Her statement to the German press agency dpa is dated October 27, 2026, and was picked up by the press the following day. It is a political intention within an ongoing reform, not an established right. The government's bill, now before the Bundestag, does not at this stage provide for unilateral return.
Current law bars the return of awards
Current law prohibits returning a Zuschlag, the administrative decision that awards an area to a winner. Only a narrow exception without penalty remains. The text, Germany's offshore wind act (WindSeeG), instead sets out financial guarantees, including a late-deposit penalty paid to the federal budget.
It also provides for completion deadlines and delay penalties paid to the responsible grid operator. In the event of a breach, revoking the award is mandatory. Relief applies to delays that occur through no fault of the developer. The recipient of any return penalty is not specified in the documents consulted.
Dynamic auctions and deferred payments
The record auction amounts stem from a so-called dynamic mechanism. When several bidders offer the same zero support tariff, they are separated by a payment made to the state. That payment is split between a small share to the federal budget and a large share paid to the connected grid operator, intended to reduce electricity costs.
The large share is spread over many years, while the small share is due quickly. Cumulative payments from the most lucrative auctions reach very high sums, concentrated among oil and gas groups. BP, whose assets are now held in the JERA Nex bp joint venture, and TotalEnergies are among the developers concerned.
